Suspension of receipt of certain requests

As of September 3, 2024, the receipt of certain LMIA applications for job offers in the administrative region of Montreal (06), whose offered salary is lower than the current median hourly wage in Quebec (27.47 $/h), is suspended for a period of 6 months. The federal government's refusal to process measure and its exemptions apply to the administrative region of Montreal (06), as long as the unemployment rate in the Montreal CMA remains at 6% or higher.
The federal government refuses to process certain LMIA applications submitted for low-wage positions in census metropolitan areas (CMAs) that have an unemployment rate of 6% or higher.

HIRE A TEMPORARY FOREIGN WORKER WITH LMIA IN QUEBEC

In Quebec, most employers must obtain validation of the job offer from the provincial and federal government. The applications must be submitted to these authorities simultaneously.
RECRUITMENT REQUIREMENTS
Employers must conduct recruitment efforts to hire Canadians and permanent residents before offering a job to a temporary foreign worker.
Before applying for a Labour Market Impact Assessment, most employers must conduct at least 3 different recruitment activities:
  • You must advertise on the Government of Canada's Job Bank. If you choose to use an alternative method, you must submit a written rationale and explanation of the alternative method
  • You must also conduct at least 2 additional methods of recruitment that are consistent with the occupation (targets an audience that has the appropriate education, professional experience or skill level required for the occupation). One of the methods used must be national in scope, and easily accessed by residents of any province or territory, as people in high-wage positions are often mobile and willing to re-locate for work
Sectors of activities exempted from the measure to refuse to process
Applications submitted to fill certain occupations in the following sectors and subsectors will continue to be eligible for processing :
  • Occupations under primary agriculture
  • NAICS 23 – Positions in construction
  • NAICS 311 – Positions in food manufacturing
  • NAICS 622 – Positions in hospitals
  • NAICS 623 – Positions in nursing and residential care facilities
  • Specific in-home caregiver positions under :
    • NOC 31301 – Registered nurse or registered psychiatric nurse
    • NOC 32101 – Licensed practical nurse
    • NOC 44100 – Home childcare providers
    • NOC 44101 – Attendant for persons with disabilities, home support worker, live-in caregiver, personal care attendant
    • ESDC and IRCC are evaluating the impact of the inclusion in future measures
  • Positions in support of permanent residency only (no application for work permit)
