WHAT IS OPEN WORK PERMIT CANADA?

An open work permit is a Canadian work authorization, limited to eligible applicants living in Canada. This type of work permit allows you, to work for any employer during the spousal sponsorship process or the validity of the study permit or work permit of your spouse or common law-partner
SPOUSE OPEN WORK PERMIT BASIC REQUIREMENTS
To qualify for the open work permit of a spouse or common-law partner you have to be living in Canada and have a valid immigration status. You also need to meet the general eligibility requirements for a Canadian work permit.
WHO CAN APPLY FOR SPOUSE OPEN WORK PERMIT?
The following categories may be eligible to apply for the spouse open work permit :
As a spouse, common-law partner or a family member of an international student you can apply for the open work permit if you are accompanying a full-time student who has a valid study permit at a public post-secondary school, such as a college, university, private college-level school in Quebec or CEGEP in Quebec OR a Canadian private school that can legally award degrees under provincial law . You also need to meet the general eligibility requirements for a Canadian work permit.
You may be eligible to apply for an open work permit If one of the following situations apply to your spouse or common-law partner, the temporary worker and holder of the valid work permit of at least 6 months: If your spouse or partner is working in an occupation under the following National Occupational Classification (NOC) skill type:
  • NOC O : management occupation
  • NOC A: professional occupation or
  • NOC B: technical or skilled tradesperson
You also need to meet the general eligibility requirements for a Canadian work permit
If you are being sponsored by your spouse or common-law partner through the Inland sponsorship in Canada Class and you have a valid immigration status in Canada you may qualify for an open work permit. You also need to meet the general eligibility requirements for a Canadian work permit.
Spouse or common-law partner of work permit holder who have a valid work permit for at least 6 months and have been nominated for permanent residence by one of the Canadian provinces is entitled to an open work permit. the validity of the work authorization will be the same of the duration of the work permit held by your spouse or partner, the principal applicant of the Provincial Nominee Class (PNC), regardless of the skill level of the PNC applicant's occupation.
You also need to meet the general eligibility requirements for a Canadian work permit
If you are a spouse or common-law partner of the principal applicant of Permanent Residence under the Canadian Experience Class (CEC) who is holder of a valid work permit, you qualify for an open work permit. There are no set preconditions to be met by the principal CEC applicant.
You also need to meet the general eligibility requirements for a Canadian work permit
Your spouse, the applicant of Permanent Residence under the Federal Skilled Trades Class (FSTC) and holder of a valid work permit of at least 6 months must be performing work that is within one of the skilled trade occupations. National Occupational Classification (NOC) skill level B (technical or skilled tradesperson).
You also need to meet the general eligibility requirements for a Canadian work permit
You may be eligible to apply for an open work permit If one of the following situations apply to your spouse or common-law partner, the holder of the valid work permit of at least 6 months:
  • If you are the spouses or common-law partners of Agri-Food Pilot applicant (AFP) who is working in a job under the National Occupational Classification (NOC) skill type O, A or B (management occupation or professional occupation or technical, skilled tradesperson).
  • If you are the spouse or common-law partner of an applicant for the Atlantic Immigration Pilot Program (AIPP) who is working in a job under the National Occupational Classification (NOC) skills type O, A, B or C.
    • NOC O : management occupation
    • NOC A: professional occupation or
    • NOC B: technical or skilled tradesperson
    • NOC C: intermediate jobs that usually call for high school and/or job-specific training.
You also need to meet the general eligibility requirements for a Canadian work permit.
